By accessing, browsing, or using PliantTV ("Service," "Platform," "we," "us," or "our"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

We reserve the right to modify, update, or change these Terms at any time with or without prior notice. Your continued use of the Service following any modifications constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically for changes.

2. Eligibility

To use PliantTV, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable laws
  • Not have been previously banned or suspended from the Platform

By using the Service, you represent and warrant that you meet all eligibility requirements. We reserve the right to verify your age and identity at any time and may terminate your access if we have reason to believe you do not meet these requirements.

3. Account Registration and Security

3.1 Account Creation

To access certain features of PliantTV, you must create an account. When registering, you agree to provide accurate, current, and complete information. You must not create accounts using false or misleading information, impersonate any person or entity, or create multiple accounts for abusive purposes.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account credentials.

3.3 Account Termination

We reserve the right to suspend, disable, or terminate your account at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violations of these Terms, fraudulent activity, or behavior that we deem harmful to the Platform or other users.

4. User Conduct and Prohibited Activities

When using PliantTV, you agree to abide by all applicable laws and regulations and to treat other users with respect. You expressly agree NOT to:

  • Engage in any sexually explicit conduct, display nudity, or share sexual content
  • Harass, bully, stalk, threaten, or intimidate other users
  • Use hate speech, discriminatory language, or promote violence against any individual or group
  • Share or distribute illegal content, including but not limited to child sexual abuse material (CSAM)
  • Promote or encourage illegal activities, drug use, or dangerous behavior
  • Spam, advertise products or services, or solicit other users without authorization
  • Collect or harvest personal information from other users
  • Record, screenshot, or capture video chats without the explicit consent of all participants
  • Impersonate another person, organization, or entity
  • Use bots, automated scripts, or other unauthorized means to access the Service
  • Attempt to circumvent any security measures or restrictions
  • Interfere with or disrupt the Service or servers
  • Upload or transmit viruses, malware, or other malicious code
  • Use the Service for any commercial purpose without our written consent

5. Content and Intellectual Property

5.1 User Content

You retain ownership of any content you create or share through the Service ("User Content"). By sharing User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of operating and improving the Service.

"PliantTV," "Pliant," and associated logos are trademarks or registered trademarks of PliantTV. You may not use these marks without our prior written permission.

6. Premium Subscription

6.1 Subscription Plans

PliantTV offers premium subscription plans that provide additional features. By subscribing to a premium plan, you agree to pay the applicable subscription fees as described at the time of purchase.

6.2 Billing and Payment

Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your selected plan). Payment is processed through our third-party payment processor, Stripe. By providing payment information, you authorize us to charge your payment method for all subscription fees.

6.3 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date. You may cancel your subscription at any time through your account settings.

6.4 Refunds

Subscription fees are generally non-refundable. However, we may provide refunds at our sole discretion on a case-by-case basis.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your personal information.

8. Third-Party Services

The Service may contain links to third-party websites or services that are not owned or controlled by PliantTV. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by or in connection with the use of any such content, goods, or services available on or through any such websites or services.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. WE MAKE NO WARRANTY REGARDING THE QUALITY, ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS, OR RELIABILITY OF ANY CONTENT OBTAINED THROUGH THE SERVICE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PLIANTTV, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

11. Indemnification

You agree to defend, indemnify, and hold harmless PliantTV, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PliantTV operates, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules.

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and PliantTV concerning the Service and supersede all prior agreements, understandings, negotiations, and discussions, whether oral or written.
